1.<\/strong> Scope<\/strong> <\/strong><\/p>\n\n\n\n

BiggerWorks BV a privately owned company based on Danzigerkade 5 at Amsterdam, The Netherlands, registered at Chamber of Commerce in Amsterdam under 34278092 (hereafter called \u201cBiggerWorks\u201d) invites you to read carefully these general terms & conditions of sale (hereafter \u201cGTC\u201d) which regulate the purchase of BiggerWorks products (\u201chereafter called Products\u201d) via the website www.waterkaarten.ap<\/a>p and the mobile applications of which BiggerWorks is the owner.<\/p>\n\n\n\n

Your use of the products and websites is also subject to our Terms of Use<\/a> and Privacy Policy<\/a>.<\/p>\n\n\n\n

BiggerWorks\nreserves the right to amend periodically these GTC by publishing an updated\nversion on the websites and in the apps.
\nThe use of the websites after publishing said amendments will determine the\nacceptation of the same. <\/p>\n\n\n\n

2.<\/strong> <\/strong>Entering into an agreement <\/strong><\/p>\n\n\n\n

2.1 You can place\nan order on www.waterkaarten.app<\/a> or\nother Bigger Works websites for the purchase of a Product if you are aged 18 or\nover. Orders can also be placed in appstores such as Apple Appstore of Google\nPlaystore. In case of a purchase in an appstore, the terms and conditions of\nthe appstore apply, next to these GTC.<\/p>\n\n\n\n

2.2 The acceptance\nof each purchase order is subject to the effective availability of the related\nProduct. The Products offered on the websites could not be available or be\navailable in limited quantities. <\/p>\n\n\n\n

2.3 When making a\npurchase order for Products on the websites, you must follow the instructions\non the websites that describe how to make your order and to make changes\nto your order before submitting it.<\/p>\n\n\n\n

2.4 By clicking\n\u201cPurchase\u201d, you place a binding order relating to the Products contained in the\nvirtual basket, accepting the GTC current at the date you submit your order.\nOnce the order is submitted and the related payment has been made, BiggerWorks\nwill send you an email for the confirmation of the order. The sale agreement\nshall be concluded between BiggerWorks and the user once the latter receives\nthe confirmation of the order. <\/p>\n\n\n\n

2.5 BiggerWorks\nreserves the right to refuse an order, wholly or partially, in the following\ncases: <\/p>\n\n\n\n

– if the Product\nis not available;<\/p>\n\n\n\n

– if your billing\ninformation is not correct or not verifiable;<\/p>\n\n\n\n

– if your order is\nflagged up by the security systems as an unusual order or as an order virtually\nfraudulent;<\/p>\n\n\n\n

– if we have\nreason to believe you are under 18; <\/p>\n\n\n\n

– if it is\nimpossible to deliver to the address provided by you or you have provided us\nwith an incorrect address or an address outside the countries\nwhere BiggerWorks ships the Products as specified within the Services.<\/p>\n\n\n\n

3.<\/strong> <\/strong>Prices, shipping charges<\/strong><\/p>\n\n\n\n

3.1 The sale price\nof each Product is as published on the Services at the moment you submit the\nrelated purchase order. The price is confirmed by the e-mail by\nwhich BiggerWorks confirms the receipt of the purchase order. <\/p>\n\n\n\n

3.2 All the\npublished prices are in Euros or possibly in the local applicable currency and\ninclusive of VAT, if applicable. When contemplated, the shipping charges\ninitially are indicated separately; said charges are indicated at the moment of\nthe preparation of the purchase order and are included in the total price\ndisplayed in the order. In the case of delivery in countries outside the EU\ncustoms duties, taxes and other levies that may apply shall be borne by the\nuser. <\/p>\n\n\n\n

3.3 In\ncase BiggerWorks becomes aware of a manifest error in the indication of\nthe price of the ordered Products or the shipping charges, you will be\nimmediately informed and will be offered the possibility to confirm the order\nat the corrected price or to cancel it. Unless despatch of your order has been\nconfirmed, BiggerWorks will not be obliged to supply products at the\nincorrect price. If you elect to cancel the order, BiggerWorks will\nreimburse the paid amount within 14 days from the receipt of the communication\nby which the user informs BiggerWorks about his decision to cancel the\norder. BiggerWorks may release discounts or promotional vouchers within\npromotional campaigns. These cannot be bought and can be used for a limited\nperiod of validity. Certain Products may be excluded from voucher promotions.\nThe use of promotional voucher could be subject to a minimum amount and in\ngeneral, to any further restrictions made available by BiggerWorks within\nthe related promotional campaign.<\/p>\n\n\n\n

The value of the\nProduct(s) bought must be equal or higher than the value of the promotional\nvoucher. If the credit of a promotional voucher is insufficient for the order\nyou wish to make, you may make up the difference through one of the payment\nmethods accepted. The credit of a promotional voucher does not accrue interest\nnor does it have a cash value. The promotional vouchers will not be reimbursed\nif you decide to return, partially or totally, the Products ordered. The\npromotional vouchers can be used only if the order is finalized, cannot be used\nretroactively and cannot be assigned to third parties. Unless stated otherwise,\npromotional vouchers cannot be used in conjunction with other promotional\nvouchers for the same order. <\/p>\n\n\n\n

3.4 Bigger\nWorks accepts the following credit cards through Stripe payment gateway and app\nstore payment services: iDEAL, MasterCard, Visa<\/p>\n\n\n\n

3.5 By\nusing a credit\/debit card to pay for your order, you warrant and confirm that\nthe card being used is yours. All credit\/debit card holders are subject to\nvalidation checks and authorisation by the card issuer. If the issuer of your\ncard refuses to authorise payment we will not accept your order, we will not be\nobliged to inform you of the reason for the refusal, and we will not be liable\nfor non-delivery. We are not responsible for your card issuer or bank charging\nyou as a result of our processing of your credit\/debit card payment in\naccordance with your order.<\/p>\n\n\n\n

4. Delivery <\/strong><\/p>\n\n\n\n

BiggerWorks will\nuse all reasonable efforts to deliver the Products ordered within the\ntimescales indicated on the order confirmation. Generally, unless stated\notherwise, the delivery takes from one to five working days from the\nmoment BiggerWorks receives your order. In any case, such timescales are\nnot guaranteed delivery times and should not be relied upon. Erroneously\ncommunicated addresses are the responsibility of the user and may lead to extra\ncharges that will be recovered from the user. <\/p>\n\n\n\n

5.<\/strong> <\/strong>Title retention<\/strong><\/p>\n\n\n\n

BiggerWorks will\nretain title in the sold Products until receipt of the payment of the Products\nand of any shipping charges. <\/p>\n\n\n\n

6.<\/strong> <\/strong>Right of withdrawal and Refund\nPolicy<\/strong><\/p>\n\n\n\n

6.1 You, as\nConsumer, have the statutory right to withdraw from this agreement without any\npenalty and without giving any reason, within 14 days\nfrom the day on which you or a third party and indicated by you acquires\nphysical possession of the goods. In the case of multiple goods ordered by you\nin one order and delivered separately, the withdrawal term will expire after 14\ndays from the day on which you or a third party other than the carrier and\nindicated by you acquires physical possession of the last of the Products.\n\u201cConsumer\u201d means any natural person who is acting for purposes which are\noutside his trade, business, craft or profession. <\/p>\n\n\n\n

Without\nprejudice to your statutory rights, BiggerWorks provides you with the\nright to return the Products within 14 days from the date you or a third party\nindicated by you acquires physical possession of the goods under the same\nconditions as set out below for the statutory withdrawal right.<\/p>\n\n\n\n

6.2 In order to\nexercise the right of withdrawal or cancellation, you shall\ninform BiggerWorks about your decision to withdraw from this agreement by\nmeans of the \u201cReturn Procedure\u201d to which you\nmay access via the website. <\/p>\n\n\n\n

To meet the\ncancellation deadline, it is sufficient for you to send your communication\nconcerning your exercise of the right to cancel before the cancellation period\nhas expired. <\/p>\n\n\n\n

6.3 If you withdraw\nfrom or cancel this agreement, BiggerWorks will reimburse to you all\npayments received from you, including the cost of delivery (except for\nsupplementary costs arising if you chose a type of delivery other than the\nleast expensive type of standard delivery offered by us). <\/p>\n\n\n\n

BiggerWorks will\nmake the reimbursement without undue delay and not later than 14 days from the\nday on which you completed the \u201cReturn Procedure\u201d.<\/p>\n\n\n\n

BiggerWorks will\ncarry out such reimbursement using the same means of payment used for the\ninitial transaction, unless you have expressly agreed otherwise; in any event,\nyou will not incur any fees as a result of such reimbursement. You are only\nliable for any diminished value of the goods resulting from the handling other\nthan what is necessary to establish the nature, characteristics and functioning\nof the goods.<\/p>\n\n\n\n

BiggerWorks may\nsuspend the reimbursement until it has received the goods back in order to\ncheck the status of the Products returned. <\/p>\n\n\n\n

6.4 You shall send\nback or deliver the Products to BiggerWorks to the address which will be\nindicated during the \u201cReturn Procedure\u201d, without undue delay and in any event\nnot later than 14 days from the day on which you complete the \u201cReturn\nProcedure\u201d. The return of the Products will be at your own cost, unless stated\notherwise by BiggerWorks. The deadline is met if you send back the goods before\nthe period of 30 days has expired. You will have to bear the direct cost\nof returning these goods.<\/p>\n\n\n\n

6.5 The right of\nwithdrawal does not apply in the event of delivery of goods:<\/p>\n\n\n\n

– made to the\nconsumer\u2019s specifications or clearly personalized; <\/p>\n\n\n\n

– that are not\nsuitable for returns for reasons involving health protection or hygiene if\ntheir seal has been broken post-delivery;<\/p>\n\n\n\n

– which are, after\ndelivery, according to their nature, inseparably mixed with other items;<\/p>\n\n\n\n

– consisting in\nsealed audio or sealed video recordings or sealed computer software which were\nunsealed after delivery. <\/p>\n\n\n\n

Purchases via the\nwebsite www.waterkaarten.app<\/a> or other\nBiggerWorks websites will entirely be processed by BiggerWorks, including the\nReturn Policy. Purchases via appstores are subject to the applicable appstore terms\nand conditions. <\/p>\n\n\n\n

7.<\/strong> <\/strong>Guarantee and\nliability <\/strong><\/p>\n\n\n\n

7.1 If a Product\nis physically damaged or defective, BiggerWorks will repair, exchange or\nrefund the purchase price of the product, as appropriate, in accordance with\nyour statutory rights and warranty.<\/p>\n\n\n\n

7.2 Our policy on\ndefective Products does not affect your legal rights.<\/p>\n\n\n\n

7.3 If you believe\na Product bought from BiggerWorks is defective, you must contact\nthe BiggerWorks Customer Service, by sending an email to the following\naddress: support@waterkaarten.app or by phone\nstated on the website.<\/p>\n\n\n\n

9.<\/strong> <\/strong>Protection of personal data<\/strong><\/p>\n\n\n\n

By accepting these\nGTC, you declare to have read, understood and fully accepted the provisions\nwhich regulate the protection of personal data, included in the specific\nsection available within the Services. <\/p>\n\n\n\n

10.<\/strong> <\/strong>Applicable law and\njurisdiction <\/strong><\/p>\n\n\n\n

These GTC shall be\ngoverned exclusively by Dutch law.<\/p>\n\n\n\n
